FOR ORDERS PLACED ON THE SITE www.ladispensadellacasalinga.it owned by LA CASALINGA SAS DI FERRAIOLI LUIGI & C.
1.1. The Contract has as its object the sale of the Products indicated and offered by the Seller on the Website www.ladispensadellacasalinga.it. Therefore, through these General Conditions of Sale, the Seller sells in the Italian territory and the Customer purchases remotely in the Italian territory the Products chosen and present on the Website www.ladispensadellacasalinga.it;
1.2. The essential characteristics of each Product offered for sale on the Website www.ladispensadellacasalinga.it are presented with the image of the product and the relevant product sheet which contains, among other things: the name of the product, the physical state in which the product is found, the specific treatment it has undergone, the list of ingredients and all the substances used in production, the presence or absence of vegetable oils or vegetable fats with an indication of the specific origin, minimum storage time after opening (in the case of foods that last longer with the words "To be consumed preferably by"), the nutritional declaration and additional information, i.e. advice and suggestions on the specific consumption of the food product offered for sale, any exclusion from the right of withdrawal, as indicated in the following paragraph 9.8. ;
1.3. The illustrative images of each Product and recommended recipe are only indicative and may not correspond to the real ones due to graphic needs used by the Seller for the presentation of the product and/or due to packaging changes by the supplier and/or due to the browser effect Internet and/or the monitor used, without this resulting in any substantial modification to the essential characteristics of the Product. Therefore, the image accompanying each Product is of a demonstrative nature and does not necessarily constitute a faithful reproduction of the dish prepared or the Product purchased. The Seller will not be responsible for non-substantial differences between the Product delivered to the Customer and its image and/or aesthetic description present on the Website www.ladispensadellacasalinga.it ;
1.4. The Contract was concluded in Italian territory via the internet, through the Customer's access to the Website www.ladispensadellacasalinga.it and the payment of the price of the Purchase Order, according to the procedure indicated on the Website and described in the following Article 3 ;
1.5. You can purchase on the Website www.ladispensadellacasalinga.it only in the event that the Product must be delivered in European territory, without this modifying the place of conclusion of the contract which is Italy.
2.1. To select the chosen product, the Customer, after carefully reading the relevant product sheet, clicks on "Add to cart" which will open a screen with the Product added to the Cart and an indication of the number of Products inserted. The operation can be repeated for other Products, without losing those already added to the cart.
2.2. By clicking on "view cart" the Customer will be able to view the details of the contents of the cart, the cost and quantity of each Product, with the possibility of modifying the quantities or removing the selected Products and possibly adding a "note" for the Seller.
2.3. Before opening the Check-out page to proceed with the Purchase, the Customer must confirm that he has read the information relating to the processing of data that will be used by the Seller for the purpose requested by the Customer. After confirmation, you can proceed to confirm the order by clicking "Check-out".
2.4. In the event that the Customer abandons the cart by closing the page in the Check-out section and has confirmed that he wishes to receive news and offers at his email address, by ticking the appropriate box, he will receive two emails from the Seller in the 36 hour time frame that can still complete the purchase process. In the event that the Purchase is not completed, the abandoned cart will be canceled and the Customer will have to repeat the procedure indicated in this article.
3.1. The Customer purchases on the Site only by providing an email or mobile phone contact on which he will receive a single-use and timed 6-digit security code to confirm his identity. On the contact provided the Customer will receive updates relating to the Purchase.
3.2. If the Customer provides his e-mail address he will receive the security code as per the previous paragraph 3.1. which will also allow them to obtain a free personal profile (account opening) to store and modify their personal data, as well as being able to view the purchase history and make returns, as indicated in the following paragraph 9.3 .
3.3. Opening the Account facilitates the purchase procedure as during the purchase phase the Customer will be able to decide on automatic compilation or autonomous compilation to modify the data entered. In any case, the Customer always has the possibility to modify their personal data. If the Customer wishes to close their personal profile by deleting the data, they can forward the request by completing the appropriate form in the "Customer Service" section, or by directly contacting the Seller.
3.4. If the mobile phone number is previously provided to the Seller, or if the automatic compilation provided by your personal browser is used, the Customer will be enabled to purchase with "Quick Check-out" and will receive the 6-digit single-use security code via text message. to be reported on the Site which will then automatically fill in the data to complete the purchase.
3.5. Before proceeding with the payment, the Customer is required to check the chosen Products, the quantities, the relative price and has the right to enter any discount code in his possession which will be calculated in the Total price to be paid and thus proceed with the payment whose data will not be visible to the Seller because it is processed by the banking transmission channels chosen by the Customer.
3.6. In the absence of payment, the order will not be purchased and the Products will remain in the cart which the Customer will be able to recover also following the warning email that the Seller will take care to forward as indicated in the previous paragraph 2.4
3.7. After making the payment, the Customer will receive an email with the Order Summary, the Order number and the Seller's contact details for any possible needs
3.8. keep the “Order Confirmation” email as proof of purchase;
3.9. the Contract is concluded when the Customer pays the "Total" price of the Order placed.
4.1. The Customer undertakes:
4.2. Failure by the Customer to comply with even some of the obligations indicated above determines the legal termination of the contract pursuant to art. 1456 cc having the same essential character for the purposes of contractual execution.
5.1. The availability of the Products refers to the moment in which the Customer consults the descriptive information of each Product. This availability must be considered indicative since, and by way of example only, it could happen that due to simultaneous purchases on the Website www.ladispensadellacasalinga.it the Product initially indicated as available is no longer available at the time of the Order Confirmation by the Seller, or because the purchase took place shortly before the update of the internet page for the Products made unavailable;
5.2. In the event that the Product indicated as available is not immediately available, even for the requested quantity, the Seller will notify the Customer within the following 24 working hours, using the contacts provided by the same, indicating the timescales necessary for a new availability of the Product ;
5.3 . In the event that the Customer does not agree to wait the times communicated by the Seller, the Customer, within the following 48 hours, will have the possibility to accept the Order Confirmation for the available products and the Seller will proceed without delay with shipping the Order modified and confirmed by the Customer, refunding any price already paid by the Customer relating to the products found to be unavailable; In the event that the Customer does not express any preference or does not respond to the Seller's request, the behavior will constitute the Customer's express wish to cancel the overall Purchase Order with the consequences indicated in the following paragraph 5.4.
5.4 . In the event that the Customer does not agree to wait the times communicated by the Seller and does not agree to confirm the Order for the other products ordered and available, the initial Purchase Order is canceled and the Seller will proceed without delay with a full refund of the price paid by the Customer using the same payment circuit with which the Customer made the payment;
5.5. Under no circumstances can the Seller be held responsible for any unavailability of the Product communicated to the Customer before sending the Order Confirmation.
6.1. All prices of the Products indicated on this Site are expressed in Euros "€" and are inclusive of taxes, applicable duties and standard packaging ("Subtotal") with the exclusion of any commission costs for particular means of payment as indicated in the paragraph 7.4 and shipping and delivery costs;
6.2. The Seller reserves the right to change the price of each Product at any time and without notice. In any case, the price charged to the Customer will be that indicated on the Website www.ladispensadellacasalinga.it at the time of placing the Order and any changes (increasing or decreasing) subsequent to the placing of the Order by the Customer will not be taken into account;
6.3. A promotional discount - discount code, which cannot be combined, may be applied to the list price of the Product:
7.1. The payment of the "Total" indicated in the "Check-out" can be made after clicking on "Pay now" by entering the credit card details with 3 D Secure on the circuits indicated on the Website www.ladispensadellacasalinga.it. :
7.2. To guarantee maximum security, the Customer will carry out the payment transaction via a protected connection on the Shop Pay, PayPal and GPay platforms and in any case directly with the credit institution that manages the online payment system. The financial information (for example, the credit/debit card number, secret code) that the Customer will use for the payment transaction are encrypted and transmitted directly to the payment manager without passing through the servers used by the Seller which therefore does not has access to such information, nor can it save or store it;
7.3. The Shop Pay, PayPal and GPay platforms, if permitted directly by the Customer, automatically use the data stored by the Customer on those platforms and/or by the browser used. This data is not visible to the Seller but the Customer can complete the procedure more quickly by proceeding with the payment based on the verification and security systems required by the payment circuit chosen from those made available to the Seller. Under no circumstances will the Seller charge the Customer additional costs in relation to the chosen payment instrument.
7.4. The Seller reserves the right not to accept certain payment methods for a given Order, indicating other payment methods, such as, by way of example only, the Cash on Delivery method which consists in paying the price at the time of physical delivery of the Product, in addition to any commissions whose amount will always be specified in the Check-out section;
7.5. The Customer is solely responsible for the data entered, therefore guarantees to only use credit cards of which you have legitimate availability. The Seller is not responsible for any fraudulent or illicit use of credit cards that may be made by third parties upon payment by the Customer for the Products purchased;
7.6. The Seller will send the tax document together with the shipment of the Product, anticipating the confirmation of receipt of payment with the "Order Confirmation" email. This document will be issued using the data indicated by the Customer who, therefore, undertakes to verify its correctness.
8.1. Unless otherwise specified, shipping costs are to be paid by the Customer for each Order and the amount is indicated on the "Check-out" page before the "Total" price is indicated. Different shipping costs may apply for bulky or heavy Products, also taking into account the quantity or type of Products purchased by the Customer;
8.2. The Seller will ship the Product/Products purchased from the Website www.ladispensadellacasalinga.it to the delivery address indicated by the Customer within 2 (two) working days for Italy and (2-6) from two to six working days for abroad from verification of actual payment, unless otherwise agreement between the Parties which must be in writing;
8.3. Shipping and delivery times may also vary for reasons not directly attributable to the Seller. Therefore, the Customer accepts that the shipping and delivery times indicated in the "Order Summary" are purely indicative and that at the latest the Product/Products will be delivered, except in cases of force majeure, within 30 days of the conclusion of the sales contract, as required by the Consumer Code (Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions);
8.4. It is up to the Customer to check the conditions of the Product delivered, the number of Products received, and that the packaging is intact and not damaged even at the closures. The Seller invites the Customer to indicate in the carrier's transport document any anomalies found upon delivery, therefore accepting the delivery with reservation;
8.5. The Seller will not be responsible for the failure or delayed delivery of the Products resulting from the incorrectness or incompleteness of the data provided by the Customer, as well as in the event that the courier delivers late due to circumstances attributable to the Customer;
8.6. The Customer is solely responsible for the address provided for the shipment of the purchased Products and, therefore, is always required to verify the address and all the information necessary to allow delivery (e.g. indications on the intercom, any extensions, etc.) within the times indicated;
8.7. The Customer acknowledges and accepts that in the event that it is not possible to deliver the Products due to his (or the person appointed by the Customer) not being present at the time of delivery on the day and in the agreed time slot, he must, at his own expense, contact the useful numbers present on the delivery notice left by the courier and set a new delivery date.
9.1. The Customer has the right to withdraw from the Purchase without specifying the reason and without any penalty with the right to reimbursement of all the payment received from the Seller, excluding delivery costs within 14 (fourteen) days starting from the date on which the Customer or a third party other than the carrier designated by the Customer acquires physical possession of the last Product ordered;
9.2. The Customer who intends to exercise the right of withdrawal must inform the Seller of his decision with an explicit declaration of wanting to withdraw from the contract within the specified deadline of 14 days from receipt of the Product. This declaration of the following content
“ To the attention of La Casalinga sas di Ferraioli Luigi & C. Via Redi 17/19, 20090 Buccinasco (MI):
I (indicate the name and surname) hereby withdraw from the contract concluded by me for the purchase of the Product (indicate the Product), ordered on (indicate the date) with Order number (indicate the Order number received via and -email from the Seller with the Order Confirmation) and delivered to me on (indicate the date) at the address (indicate the delivery address) signature ( Name and Surname)"
9.3. The Customer must send the explicit declaration of withdrawal by certified email to lacasalinga.sas@pec.it or by registered mail (the postmark of sending will be considered as proof) to: La Casalinga sas di Ferraioli Luigi & C. – Via Redi n. 17/19 - 20094 Buccinasco (MI),
or, alternatively, you may:
- use the form in the "Withdrawal" section, filling out the form and the Seller will send an e-mail to the address indicated by the Customer with which he will communicate the acceptance of the request and the subsequent phases for the conclusion of the procedure;
- use the form in the “Customer Service” section, always specifying the Order number. The Seller will send an e-mail to the address indicated by the Customer with which he will communicate the acceptance of the request and the subsequent phases for the conclusion of the procedure;
- after receiving the email confirming the shipment of the Order, the Customer, if he has his own personal profile, as indicated in the previous paragraph 3.2, will be able to carry out the return independently by accessing the history of his purchases which can be viewed in the orders section of the own Account and using the "Return" function, which can be viewed after the Seller has sent notification to the Customer that the Order has been shipped.
9.4. Once the request has been received, the Seller will communicate to the Customer, as soon as possible, that the request has been taken over, indicating the subsequent stages for completing the procedure.
9.5. The Product, or Products, to be returned must be intact, in the original packaging, complete in all their parts and complete with the tax and transport documentation issued. If the returned Product does not comply with what is prescribed here, the withdrawal will not be effective and the Seller will not proceed with the refund in favor of the Customer;
9.6. Without prejudice to the right to verify compliance with the above, the Seller will reimburse the payment within 14 (fourteen) days from receipt of the withdrawal notice through the same payment method used for the original transaction, without charging any cost for reimbursement. However, the Seller, as required by art. 56, paragraph 3, of the Consumer Code (Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions), may withhold the refund until it has received the goods or until the Customer has demonstrated that he has sent the goods back, depending on which situation occurs first;
9.7. The right of withdrawal is excluded , pursuant to art. 59 letters d) and e) of the Consumer Code (Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions) in the following cases:
I – products that risk deteriorating or expiring rapidly;
II – sealed products that are not suitable for return for hygienic reasons or related to health protection and which have been opened after delivery;
9.8. With reference to the cases of exclusion of the right of withdrawal, the Customer is informed and accepts that among the "products that risk deteriorating or expiring rapidly" or among the "sealed products that are not suitable for return for hygienic reasons or related to the protection of health” include some of the food products on sale on the Website www.ladispensadellacasalinga.it as the characteristics and qualities of these types of Products are subject to alteration and deterioration also as a result of inappropriate storage. Therefore, for hygiene and customer protection reasons, the right of withdrawal may not be applicable for all products purchased on the website. www.ladispensadellacasalinga.it;
9.9. The Seller informs the Customer in advance of the possibility or otherwise of exercising the right of withdrawal within each "PRODUCT SHEET" where the essential characteristics of the Product are summarized , as indicated in the previous paragraph 1.2.
10.1. All Products sold on the Website www.ladispensadellacasalinga.it are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Consumer Code (Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions) and covers all defects in conformity which manifest themselves within 24 months from the date of delivery of the Product to the Customer;
10.2. Pursuant to the provisions of articles 130 and 132 of the Consumer Code (Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions) if at the time of receipt, the Product is defective or in any case presents non-conformities with respect to the Orders placed, the Customer has the primary right to restore, without charge, the conformity of the good through repair or replacement, without charge, of the conformity of the good through repair or replacement of his choice with a similar Product of the same amount, unless the remedy is objectively impossible or excessively onerous, or, secondarily, to an adequate reduction in the price or termination of the contract. The Customer may also request the issue of a purchase voucher "discount code" for an amount equal to the price of the defective Product previously purchased. The Customer loses these rights if he does not report the lack of conformity to the Seller within two months from the date on which he discovered the defect. The legal guarantee of conformity expires 24 months after the date of delivery of the Product;
10.3. The Customer must inform the Seller at shop@ladispensadellacasalinga.it of the lack of conformity within 2 (two) months from the date of discovery of the defect, unless the Product is subject to expiry of conservation in a longer term short and in this case the defect must be reported within the expiry date of the defective Product;
11.1. In the event that the Product is delivered to the Customer not intact or evidently damaged or the quantities and/or type of the Product delivered do not correspond to the Purchase Order sent by the Customer, or in the event of anomalies found on the Product, the Customer must contact the Seller at shop@ladispensadellacasalinga.it , making a specific report and attaching suitable photographic documentation to prove the lack of quality of the Product, or by filling out the appropriate form in the "Customer Service" section;
11.2. The Product that does not comply with the Purchase Order in terms of quantity, quality and/or type must be returned to the Seller, according to the terms and methods that the Seller himself will indicate to the Customer using the contacts indicated by them, in the original packaging, complete in all its parts, including any warranty seal, undamaged, unused or in any case not manipulated and equipped with all original accessories that are part of the Product. Otherwise the Price will not be refunded to the Customer;
11.3. The Seller reserves the right to verify the actual existence of the defect complained of by the Customer and the existence of the conditions for reimbursement or replacement of the Product, also based on the choice option communicated by the Customer;
11.4. Having ascertained that the Customer's right exists, the Seller will replace the Product as quickly as possible, also based on the choice option communicated by the Customer, and issue a "discount code" purchase voucher for the amount not lower than that of the price of the defective Product, or to a full refund of the Price paid through the same payment method used by the Customer, without charging any expenses or charges to the Customer.
12.1. The Seller reserves the right to modify, update or integrate the Website www.ladispensadellacasalinga.it and /or these General Conditions of Sale at any time.
The Customer who accesses the Website www.ladispensadellacasalinga.it and submits a Purchase Order will adhere to the policies and terms of the General Conditions of Sale from time to time in force at the time the Purchase Order is placed, unless any changes have retroactive effect in force of applicable law;
12.2. If the Customer does not agree with the changes made to the General Conditions of Sale, he is invited not to purchase from the Website www.ladispensadellacasalinga.it ;
12.3. If any provision of these General Conditions of Sale is deemed invalid, void or for any reason inapplicable, this condition will not in any case affect the validity and effectiveness of the other provisions.
13.1. The Seller undertakes to comply with the quality standards relating to the Products sold on the Website www.ladispensadellacasalinga.it exclusively until the moment of physical delivery of the Product to the place indicated by the Customer. Therefore, the Seller assumes no responsibility for the poor condition of the Products due to improper storage subsequent to the time of delivery or at other delivery points authorized by the Customer;
13.2. The Seller assumes no responsibility for disservices attributable to force majeure such as, by way of example, epidemics, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, , to execute the contract within the agreed times and will not be liable to any party or third party for damages, losses and costs suffered as a result of failure to execute the contract for the causes mentioned above. It is understood that in this case the Customer will have the right to a full refund of the price paid;
13.3. The Seller assumes no responsibility for damages, losses and costs suffered by the Customer due to failure to execute the contract due to reasons not attributable to it. It is understood that in this case the Customer will have the right to a full refund of the price paid;
13.4. The Seller is not responsible for any fraudulent or illicit use of credit cards that may be made by third parties, as at no time during the purchase procedure is it able to know the credit card number and financial data.
14.1. Pursuant to article 14 of Legislative Decree no. 70/2003, the Seller informs the Customer that each Order sent is stored in digital/paper form on electronic devices located at the company's headquarters according to the confidentiality and security criteria established by sector regulations.
14.2. As regards the processing and protection of personal data, the Seller will process the Customers' personal data in compliance with the legislation as defined in detail in the information on data processing provided pursuant to art. 13 GDPR 679/2016 to which reference is made and available in the specific Privacy Policy section at the bottom of each web page of this Site www.ladispensadellacasalinga.it
15.1. These General Conditions of Sale as well as the purchase contract for the Products through the Website www.ladispensadellacasalinga.it is governed by Italian law;
15.2. Legislative Decree 6 September 2005, n. applies. 206 (Consumer Code) with specific reference to distance contracts and subsequent amendments and additions, Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce and art. 9 of EU Reg. 1169/2011 relating to Information Obligations for the supply of Food Products to Consumers;
15.3. For any dispute relating to the validity, interpretation or execution of these General Conditions of Sale, the territorial jurisdiction lies with the Judge of the place of residence or domicile of the Customer within the Italian territory because the Contract is considered concluded in Italy;
15.4. Pursuant to art. 14 of Regulation 524/2013, the Customer is also informed that in the event of a dispute, he/she may submit a complaint with a request for "Online Dispute Resolution" via the European platform established by the European Union for the online resolution of consumer disputes, called "ODR platform". ”. The ODR platform can be reached at the following link https://ec.europa.eu/consumers/odr/main/?event=main.home.show . Through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the website of each of them and start an online resolution procedure for the dispute in which he is involved.
16.1. The Customer may contact the Seller for any communication and as necessary for the conclusion and execution of this contract at the following addresses, provided by the Seller to allow the Customer to contact him quickly and effectively:

16.2. For reports or complaints relating to the service offered, the Customer can contact the Seller at the following addresses which will be processed by the Seller within 10 (ten) days of receipt:
